Welcome to Exist Green. These Terms govern your use of existgreen.com and your purchase of products and services from us. By using our website or placing an order, you agree to these Terms.

1. About Exist Green

Exist Green is a zero-waste market and refillery at 4914 Underwood Avenue, Omaha, Nebraska 68132. We offer local, ultra-seasonal produce; organic, plant-based, and gluten-free pantry goods; sustainable swaps; and hundreds of refillable products for grocery, personal care, and home use.

2. Acceptance of Terms

By placing an order or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or services.

3. Products + Services

3.1 Product availability

We strive to keep accurate inventory, but availability is subject to change. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion. If a product becomes unavailable after you place an order, we will notify you and provide a full refund for that item.

3.2 Product descriptions

We make every effort to accurately describe our products, including ingredients, nutritional information, and product specifications. However, we do not warrant that descriptions or other content on our website is accurate, complete, reliable, current, or error-free. If a product you receive does not match its description, please contact us for a return or exchange.

3.3 Pricing

All prices are in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, even after an order has been placed. If we discover a pricing error, we will notify you and offer the option to proceed at the correct price or cancel for a full refund.

4. Ordering + Payment

4.1 Order acceptance

Your order is an offer to purchase products from us. We reserve the right to accept or reject your order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

4.2 Payment methods

Payment is required at the time of order placement. We accept:

• Credit and debit cards processed by Square (Visa, Mastercard, American Express, Discover)
• Apple Pay and Google Pay through Square checkout
• PayPal balance, cards, Apple Pay, and Google Pay through PayPal checkout

All payments are processed securely through our payment partners. We do not store full card numbers on our servers. See our Privacy Policy for details on payment data handling.

4.3 Order confirmation

After placing an order, you will receive an email confirmation. This is an acknowledgment that we received your order, not a guarantee that we have accepted it.

5. Fulfillment

5.1 Local pickup

Pickup orders can be collected at our store: 4914 Underwood Avenue, Omaha, Nebraska 68132. Store hours are Tuesday through Friday, 11 AM to 7 PM, and Saturday, 10 AM to 6 PM. We will notify you (by email and, if you opt in, SMS) when your order is ready. Orders not picked up within 7 days may be subject to restocking fees or cancellation.

5.2 Local delivery

Local delivery is available to Omaha-metro addresses. Delivery windows are Wednesday 9 to 11 AM (orders placed by Tuesday 5 PM) and Saturday 8 to 10 AM (orders placed by Friday 5 PM). Your order confirmation will include the scheduled delivery window.

5.3 Shipping

We ship orders throughout the United States via standard carriers (USPS, UPS, etc.). Shipping costs are calculated at checkout based on destination and package weight. Delivery times vary by location and carrier. We are not responsible for delays caused by shipping carriers.

6. Returns + Refunds

Our return and refund policy is detailed on our Return Policy page. By placing an order, you agree to the terms outlined there. Please review the return policy before purchase if you have questions about returns, refunds, or exchanges.

7. Reuse Library (Reusable Container Program)

If you participate in our Reuse Library, you agree to return borrowed containers by the specified due date. Late returns may result in fees or temporary holds on additional checkouts, as outlined in the program terms. You are responsible for keeping borrowed containers in reasonable condition and may be charged for lost or damaged items. Bringing a container in for a refill resets its return window.

8. Earthies™ 🌍✨ Rewards Program

Our Earthies™ 🌎✨ rewards program lets you earn points (Earthies™ 🌏✨) on qualifying purchases and refill activities. Points are awarded according to current program rules and can be redeemed for discounts. Points have no cash value, cannot be sold or transferred between accounts, and may expire under conditions described in the program terms. We reserve the right to modify, suspend, or discontinue the program at any time. The full program terms live on our website.

All content on this website, including text, graphics, logos, images, photographs, and software, is the property of Exist Green or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

11. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, Exist Green is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses arising from your use of our website or products.

You agree to indemnify and hold harmless Exist Green and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our website, your violation of these Terms, or your infringement of any rights of another party.

12. Privacy

Your use of our website and services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal information.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of our website will be resolved in the courts of Douglas County, Nebraska.

15. Miscellaneous

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Exist Green regarding your use of our website and services, and supersede any prior agreements.
